Recent Updates to Illinois Divorce Law
The divorce laws in Illinois were rewritten in 2015, and changes went into effect at the beginning of 2016 that are meant to reduce conflict and update some outdated terminology. Under these changes, "irreconcilable differences" is now the only grounds for divorce. In addition, if both parties agree to a divorce, it can proceed immediately. If one party does not agree, living separate and apart from each other for at least six months is considered sufficient proof of irreconcilable differences.
